Terms of Service

These Terms govern the use of volai - a platform for phone numbers, calls, SMS and an AI voice agent, available through the web interface, REST API and MCP server at volai.cz (the "Service"). By registering an account or using an API key, you agree to these Terms.

1. Who operates the Service

volai is operated by ANOVIA Finance s.r.o. (Company ID 01757237, VAT ID CZ01757237), with its registered office at Na Zámku 636, 250 81 Nehvizdy, Czech Republic, entered in the Commercial Register maintained by the Municipal Court in Prague (Městský soud v Praze), Section C, Insert 266323 (the "Operator"). Contact: podpora@volai.cz. The Operator complies with the obligations under Act No. 127/2005 Coll., on Electronic Communications.

2. Registration and account

Creating an account requires only a valid email address and a password. You agree to provide accurate information and to keep your login credentials and API keys safe from misuse - you are responsible for all activity under your account until you notify us that a key has been lost or compromised. When you purchase a geographic phone number, we store your address, since it is tied to emergency-calling requirements.

3. How the Service works

volai provides phone numbers and carries calls and SMS through a contracted partner - a Czech telecommunications operator - and runs the voice AI agent through a voice technology provider. The Service is currently in beta, without a guaranteed SLA. We aim for continuous, reliable operation, but we cannot guarantee full uptime or error-free operation. For emergency calls (112, 150, 155, 158), always use your mobile operator as the primary line - volai is not intended as your sole line for emergency calls.

4. Call recording

Calls handled by the voice agent are recorded by default. You can play a recording from the call's detail view in the portal; we keep it for 90 days after the call and then delete it - the call transcript stays in your account. Access to a recording is limited to you and our support team, when helping you with a specific call. You can turn recording off with a toggle on the agent - calls made by that agent stop being recorded from that point on. Informing the caller that the call is being recorded is your responsibility as the data controller; the safest approach is to say so right in the agent's first sentence.

5. Voice agent tools

You can configure a tool for your agent - the address of your own endpoint, which it calls during the call and uses the response in speech. You determine the address, request headers, and the list of parameters sent, and you are therefore responsible for what your endpoint does and what data we send it - which may include the caller's number and information the agent gathers during the call. We only relay the call: we send the request and pass the response to the agent. We are not responsible for the availability, content, or security of your endpoint.

6. Credit and payments

The Service runs on prepaid credit. Prices for individual actions (calls, SMS, phone numbers, the voice agent) follow the current pricing page, always available on the website. You top up credit by card, and it is drawn down as you actually use the Service - it never expires and does not lapse. Once your email is verified, a new account receives a one-time free welcome credit. Any remaining credit is refunded on request through support.

7. Prices, VAT, and invoices

The Operator is registered for VAT. Prices listed on the pricing page are exclusive of VAT. Topping up credit adds VAT at the statutory rate (21%) - so you pay more than the amount credited to your balance.

If you are registered for tax in another EU member state and provide your VAT number, the place of supply is your own country (§ 9(1) of the Czech VAT Act). In that case we invoice without Czech VAT and you self-assess and pay the tax in your own country; the invoice states "Tax to be paid by the customer" (reverse charge). This only applies once your VAT number is confirmed by the EU's VIES register - we verify it the moment you save it, and until confirmed we charge Czech VAT.

We issue a tax invoice automatically for every credit top-up made by card, and you'll find it in the portal under Credit, where you can download it as a PDF. It is issued using the billing details you have set in your account settings at the moment of payment - an invoice already issued is not amended retroactively, so add your details before you top up. For payers outside the EU we issue the invoice manually - email us at podpora@volai.cz.

8. Liability and limitations

The Service is provided "as is", in beta, and without an SLA. We are not liable for damage caused by third-party outages (telecommunications network, voice technology, payment gateway), for the content of calls and SMS sent from your account, or for indirect or consequential damages. In any event, our liability is limited to the amount of credit topped up over the preceding 12 months.

9. Termination and account cancellation

You may cancel your account at any time, with no notice period and no reason required - any remaining credit is refunded on request. The Operator may suspend or terminate an account for breach of these Terms, misuse of the Service (spam, fraudulent calls, harassment), or a persistently negative credit balance following prior notice.

10. Prohibited use

  • Mass unsolicited calling or SMS (spam, telemarketing without consent).
  • Fraudulent, threatening or harassing calls and messages.
  • Spoofing caller identification or impersonating another person or company.
  • Any conduct contrary to the applicable law of the Czech Republic.

11. Changes to these Terms

We may amend these Terms from time to time, in particular as the Service evolves. We will notify you of material changes by email or an in-app notice. Continuing to use the Service after such changes take effect constitutes your agreement to them.

12. Final provisions

These Terms are governed by the laws of the Czech Republic. We aim to resolve any disputes amicably wherever possible. Questions about these Terms or about the processing of personal data (see the Privacy Policy) should be addressed to podpora@volai.cz.
